The terms "we", "us" and "Hoteloon" refers to Hoteloon SARL, having its registered office at 8 rue Duployé, 38100 Grenoble, France. The terms “website user”, “customer”, "you" and “your” refers to the individual person visiting our website and/or the customer booking a reservation through this website. The terms “website” refers to our website www.hoteloon.com.

In introduction of the General Terms and Conditions applying to the website www.hoteloon.com, we would like to draw your attention to the fact that Hoteloon does not provide, own or run any accommodation itself and does not charge any accommodation services.

We act solely as an intermediary between the website user and the hotels: the website user and Hoteloon are not linked by any contract even after he or she has made a reservation on www.hoteloon.com.

The www.hoteloon.com website user confirms that he or she is of sufficient legal age to use this website and assures to be taking the full responsibilities and legal implications for all use of this website.

As to facilitate their reading, the General Terms and Conditions are divided in 9 chapters. The headings used in those Terms are for convenience only and shall not affect the meaning or scope of the Terms or otherwise be given other legal effect.

1.Object

The following General Terms and Conditions (hereafter referred to as the "GTC") constitute the entire agreement between you and Hoteloon about the use of our website www.hoteloon.com. Any Internet user accessing the website accepts without any reserve the GTC application and acknowledges to have read, understood and agreed to them.

The GTC are liable to changes at any time and without notice. This right shall not affect the terms accepted by you upon a previous website use. You should check those terms and you are bound by them each time you access the website or make a reservation.

2. Scope of our Service

Through the website, Hoteloon acts solely as an intermediary between you and the hotels which can advertise their rooms for reservation (hereafter referred as “the hotels”). We display selected hotels on our website et we convey to them your reservation requests which are expressed through our website. Thus we act as an independent reliable third party, and in any case as your partner, representative or subcontractor.

The hotels answer by email to your reservation requests expressed from our website. Your reservation is confirmed only after you receive an email from the hotel who confirm the prices and room availability. The hotel reserves the right to refuse your reservation request.. To send a reservation request from our website does not automatically mean that the reservation will be accepted. Only the hotel answer may confirm your reservation.

In case you receive any answer from the hotel within 48 hours, we propose you to contact for free the hotel by phone, in order to notify your reservation request. However we have no performance obligation concerning this proposal. If we don't succeed to reach the hotel by phone, you will get informed but you can't require from Hoteloon a response or a reservation from the hotel.

Although we carefully control the information provided, we are not in position to verify if, and cannot guarantee that, all information is accurate, complete or correct, including information concerning the rates of the rooms. Only the confirmation email of the hotel may confirm the information concerning your reservation.

We cannot be held responsible for any errors, any interruptions, inaccurate, misleading or untrue information or non-delivery of information. We cannot assure you that any hotel will fit your expectation. We never give recommendation, opinion or advice through information published in our website. Hoteloon disclaim all responsibility for your decision to reserve any hotel displayed in our website.

3. Free of charge

Our service is free of charge and generates no cost for you. We will not charge you or add any additional fees to the room rate offered on our website.

As our services are free of charge, we disclaim any liability for the website use or in the event of website's interruptions. For the same reasons, Hoteloon can not be sued because of possible mistakes concerning the information published on our website.

4. Prices

All prices on our website are displayed for information purpose only. The hotels gave to us their prices and they reserves the right to change their prices without notice. Only the confirmation email of the hotel may confirm the price of the rooms. Although we make a point of displaying accurate prices, changes or mistakes may occasionally happen. Hoteloon should not be held responsible for possible differences between prices on our website and the real prices offered by the hotels.

All prices on our website are per room and per night, with or without breakfast. They include every tax, except possible local occupancy taxes, which are specified in the descriptive of each displayed room.

The currency converter available on our website is for information purpose only and should not be relied upon as accurate and real time; actual rates may vary. Hotel's local currency or Euro are the only currencies that matters for the exact establishment of the rates displayed on the website. For your information, Hotel's local currency is presented in the descriptive of each displayed room.

5. Cancellation and no-show policy

By sending a reservation request from our website, you are committed to inform directly the hotel if you would like to cancel or modify your reservation. In this case, you must contact the hotel by email or by phone. You can find the email address and the phone number of the hotel in the email sent by Hoteloon at the end of the reservation process.

In case of repeated cancellations without notice, Hoteloon would reserve the right to inform our partners hotel of your behaviour and to deny access to our website.

In case of late arrival, you have to inform the hotel and to make sure your reservation is kept until your predicted arrival time. You have to get knowledge of the hotel's policy because the hotel may reserve the right to cancel your reservation if you don't arrive at the hotel before your predicted arrival time.

6. Privacy

In accordance with the « information technology and freedom » law from the 6th January 1978, and modified in 2004, you have the right to access, modify, rectify or delete your personal data at any time. Subject to legal obligation, personal information collected through the website will not be disclosed to a third party without your consent. However, for the Internet user who made the request, Hoteloon reserves the right to use their personal data to send offers likely to satisfy them.

By making a reservation on the website, you agree to receive, in addition to the booking confirmation, an email at the end of his stay intending gather your views and comments about the concerned hotel. These opinions and comments may be published on the website in order to inform about the hotel quality. You consent to give up your copyright about the expressed opinions and comments. Hoteloon reserves the right to use, at its own discretion, those views and comments, and to delete or modify them without any notice or justification.

7. Responsibility limitation

You accept and agree that, subject to the current regulation application, Hoteloon as well as any of its managers, employees and agents are not accountable for any direct or indirect cost or damages (including data, profits, client’s losses or any other corporeal or immaterial losses) suffered or paid by you and that may occur: - During the website use or because of the impossibility to use it - During your stay in any of the hotel displayed on the website More particularly, we reject any responsibility in case of a corporeal damage, death, losses or costs attributable to the hotel, including when mistakes, failures, negligence, deliberate professional misconducts or a non execution of the contract from the hotel are alleged.

Hoteloon, in any case, should not be held responsible for the violation of the rights detained by third parties and committed during the website use.

8. Intellectual property

The website entire content (including illustrations, texts, pictures, videos, wording, brands, logos, domain name) is the property of Hoteloon or of its suppliers or partners. Every information, content, file or software provided on the website is protected by French and international laws relating to intellectual property and copyright.

No element of the website can be copied, reproduced, modified, distorted, uploaded, republished, passed on or distributed in any way, on any support, partly or in full without our prior written authorization. Any illicit use or reproduction of all or part of the website will give rise to proceedings.

9. Enforceable laws

The hereby GTC and the services offered by Hoteloon are governed by the French Republic laws. You accept that any dispute linked to the website use or to services provided by us will be brought to the French Court of Paris, sole competent. The present GTC are drafted in French. Their translation in other languages than French would have a reference value only. In case of an interpretation conflict, the French version would prevail.
